1. Who we are

Stackd (stackdsa.co.za) is a student marketplace platform operated by Nuvela Group (PTY) Ltd, a company registered with the CIPC in South Africa. By creating an account or using Stackd, you agree to these terms.

2. Who can use Stackd

Stackd is built for students at universities and colleges in Gauteng, South Africa. You must provide accurate information when registering, and you're responsible for keeping your account credentials secure.

3. Listings

• Posting listings on Stackd is free — there's no account plan and no limit on how many active listings you can have.
• You're responsible for the accuracy of everything you post — item condition, price, description, and images.
• Listings must be for lawful, legitimate items or services relevant to a student marketplace. We may remove any listing that violates these terms or seems fraudulent, misleading, or inappropriate, without notice.

4. Featured Listings & payments

• The only paid feature on Stackd is Featured Listings — a once-off payment through PayFast that pins your listing to the top, either across the whole platform or within your category, for a limited period.
• Featured Listing payments are non-recurring and non-refundable once the boost has been applied, except where required by law.
• All prices are in South African Rand (ZAR).
• Featured Listing slots are limited and allocated first come, first served.

5. Promo codes

From time to time we may issue promo codes at our discretion. Any code may only be redeemed once per user per code, and we reserve the right to deactivate a code, or refuse redemption, if we reasonably suspect misuse.

6. Refunds

Payments made through PayFast for Featured Listings are generally non-refundable once the boost has been applied, except where required by South African consumer protection law. If you believe you were charged in error, contact studentstacksa@gmail.com.

7. Prohibited conduct

• Posting illegal, fraudulent, counterfeit, or prohibited items
• Impersonating another person or misrepresenting your affiliation with any institution
• Attempting to circumvent the Featured Listings payment system or platform security
• Harassing, scamming, or misleading other users

We may suspend or terminate accounts that violate these terms.

8. Transactions between users

Stackd is a platform that connects buyers and sellers — we are not a party to any transaction between users, and we don't guarantee the quality, safety, or legality of items listed. Buyers and sellers are responsible for arranging and completing transactions safely and independently, including verifying the other party and meeting in safe locations.

9. Limitation of liability

Stackd is provided "as is." To the fullest extent permitted by law, Nuvela Group (PTY) Ltd is not liable for any loss or damage arising from your use of the platform, including disputes between users, inaccurate listings, or service interruptions.

10. Changes to these terms

We may update these terms from time to time. Continued use of Stackd after changes are posted means you accept the updated terms.

11. Governing law

These terms are governed by the laws of the Republic of South Africa.
